What are the impasse procedure deadlines?

On July 1, 2024, PERB duties were assigned to the Emploment Appeal Board (EAB).  Effective December 3, iowaperb.iowa.gov will no longer be available and all information will be found at the EAB's website, eab.iowa.gov.  

Answer: 

The parties can and should attempt to agree upon an independent impasse procedure that
meets their particular needs.  If parties are using an independent impasse procedure, it
should be submitted to PERB along with the request for impasse services. However, if the
parties do not agree upon an independent impasse procedure, the statutory procedures found
in Iowa Code 20.19, 20.20, and 20.22 apply. These procedures begin no later than 120 days
prior to either the certified budget submission date of the employer or not later than 120
days prior to May 31 if the public employees are teachers licensed under Iowa Code chapter
272 and the public employer is a school district, an area education agency or a community
college. If the public employer does not have a budget certification date, the statutory
impasse procedures begin no later than 120 days prior to the commencement of the
employer’s next fiscal or budget year. Thus, absent an independent impasse agreement, the
impasse season is:

  • November 15 – March 15 – City, County or State
  • December 15 – April 15 – School District or AEA non-teachers
  • January 31 – May 31 – Community College teachers and non-teachers, AEA teachers and School District teachers
  • No budget certification date – 120 days prior to the beginning of the employer’s next fiscal or budget year.

Parties are not required to request on or before the above-listed dates. The effect of not filing by
these dates is that the impasse season is shortened as the deadline remains static.
